License Agreement for the TIGERSearch software for non-commercial use

("IMS")
and "Licensee"
 
agree as follows
 
 

1. Definitions

1.1 TIGERSearch software

"TIGERSearch software" (Version 2), a software suite for the administration and exploitation of data collections of a restricted form of graph structures (e.g. syntactically annotated text corpora), consists of the following software:

  • TIGERSearch (search engine)

  • TIGERRegistry (database administration tool)

  • TIGERGraphViewer (visualization tool for query results)
and the accompanying user documentation and technical reports.

TIGERSearch software is available for the following operating systems: SUN OS (Solaris 2.7 or higher), PC Linux, Microsoft Windows 98 or higher, Mac OS X (version 10.2.4 or higher).

1.2 Licensee's Results

"Licensee's Results" are the results of work performed by the Licensee by using the TIGERSearch software, for example
  • data (e.g. statistical, lexical, or syntactic information) derived from text corpora with the help of the TIGERSearch software,

  • software which has been derived from the TIGERSearch software, e.g. by combining the TIGERSearch software with some other software.

2. Terms of the Licence Granted to the Licensee

  1. TIGERSearch software includes third party data and software as listed in the Appendix. IMS recognizes that the copyrights of these data and software belong to the respective organisations, as mentioned in the Appendix.
  2. IMS grants a royalty-free, non-exclusive, non-transferable Licence to the Licensee to use the TIGERSearch software for research and evaluation purposes.
  3. Distribution of the TIGERSearch software and of the Licensee's Results is restricted to the Licensee.
  4. The Licencee must not, except as herein provided, copy, publish or otherwise give to any third party access to the whole or any part of the TIGERSearch software and to the Licensee's Results.

    If Licensee is an Organization:

    It is the responsibility of the Organization to ensure that its members understand and abide by this restriction, and to supervise their activities with respect to the TIGERSearch software and the Licensee's Results.
    The Licensee may not assign, transfer, lease, sell, rent, charge or otherwise encumber the TIGERSearch software or the Licensee's Results.
    However, in the event of Licensee's Results being data, the Licensee may quote small portions from the Licensee's Results in scientific publications or other kinds of publications.

3. Limitation of Liability

  1. The IMS gives no warranties and makes no representation that the TIGERSearch software will be suitable for any particular purpose, or for use under any specific conditions.
  2. The IMS accepts no responsibility for any technical limitations of the TIGERSearch software.
  3. In no circumstances will the IMS be under any liability to the Licensee for loss of profits, goodwill or any kind of consequential losses of any nature even if such loss was foreseeable.
  4. The IMS shall accept no liability whatsoever in connection with any damage to the tangible property of the Licensee resulting from the negligence of the IMS, its employees, agents or sub-contractors.
  5. The IMS is under no obligation to maintain or support the TIGERSearch software. However, the IMS may, at its discretion, provide the Licensee with updates of the TIGERSearch software during the term of this Agreement. Any update of the TIGERSearch software shall be covered by the provisions of this Agreement.

4. Termination

  1. The IMS may terminate the Agreement forthwith if the Licensee commits any material breach of this Agreement.
  2. The Licensee may terminate this Agreement by giving one week's notice in writing to the IMS.
  3. On termination howsoever caused, the Licensee shall erase all copies of the TIGERSearch software and of the Licensee's Results.

5. Jurisdiction

These terms will be governed by German law and the court in Stuttgart, Germany, will have sole jurisdiction.

In the case that this Agreement should be incomplete or that one of its provisions should be inoperative, the Agreement as such will remain in effect. An inoperative provision or missing provision shall be replaced by an operative provision which fits the intentions of this Agreement.
